Tender Description

This Tender is invited by the Issuer.

⁠⁠⁠Conditions for Participation

All Sellers must be an Indigenous Enterprise at the time of responding to this RFQ. The Buyer will exclude a Seller from further consideration if the Buyer considers that the Seller does not meet the condition of being an Indigenous Enterprise at the time of lodging its Quote, unless the Seller’s status is rectified prior to entering into the Contract.

Requirements

The Buyer is seeking a Seller to:

  • plan and manage the User Acceptance Testing process fora web product currently under development
  • plan and develop an end user training framework to support the implementation of the web product, including the development of training materials and videos.

Negotiations

1. Without limiting any other rights in this RFQ, the Buyer may do any or all of the following at any time:

shortlist one or more Sellers and seek further information from them;

enter into negotiations or discussions with one or more Sellers;

subject to the clause 2, discontinue negotiations or discussions with a Seller, whether or not the Seller has been notified that it is the preferred Seller;

seek amended Quotes or call for new Responses from one or more Sellers, provided it provides a common deadline for such Sellers to submit an amended or new Quote; and

negotiate with one or more persons who have not submitted Quotes or enter into a contract or other binding relationship for similar goods or services to the Requirement outside this RFQ.

2. Where the Buyer eliminates a Seller that is participating in negotiations, it will do so in accordance with any essential requirements and criteria for evaluation specified in the RFQ.

Procurement information sharing within the Commonwealth

1. The Buyer may, without the prior written authorisation of the Seller, disclose any Confidential Information of the Seller:

  • to its personnel, advisers and contractors in connection with the Contract or related activities;
  • within the Buyer’s organisation, or with another Commonwealth entity, where this serves the Commonwealth’s legitimate interests;
  • to a Minister or in response to a request by a House or a Committee of the Parliament of the Commonwealth of Australia;
  • when it is authorised or required by law to be disclosed; or
  • which is in the public domain otherwise than due to a breach of this clause.

2 Except in clauses 1. (a)-(e), the Buyer will not, without the prior written authorisation of the Seller, disclose any Confidential Information of the Seller to a third party.

3. Where the Buyer discloses Confidential Information to another person pursuant to clauses 1. (a) to (c), the Buyer will use reasonable endeavours to ensure that the receiving person is aware that the information is confidential.

4. The obligations in this clause survive the expiry or termination of the Contract.
